The court held that it was expedient to appoint the proposed trustee under the court's inherent jurisdiction (applying the expediency test of s42 Trustee Ordinance) because the sole trustee had died, beneficiaries could not be traced and the trust assets required management; accordingly Tam Man Sze Marcia was appointed sole trustee, the land was vested in her and the balance in the frozen bank account was ordered to be transferred to a new trust account, and the applicant's costs were indemnified out of the trust assets.
