The Court of Appeal held the Authority did not breach procedural fairness: confidentiality under section 27 of the Broadcasting Ordinance constituted a valid countervailing factor; the Redacted Summary and disclosed documentary material were sufficient to enable ATV to make meaningful and focused representations; the judge below erred in factual assessment and in concluding non‑disclosure was unfair, therefore the quashing order was set aside.
