The Court held that Article 12(1) entitles an offender to the benefit of a lighter penalty introduced by subsequent legislation even when the original provision was repealed and replaced by re-enactment that effectively creates the same offence with a lower maximum; the sentence based on the old higher maximum was excessive and the applicant must be discharged.
