The Court held the Applicants' 9 December 1998 letter was an objection under section 53 of the Immigration Ordinance which required consideration by the Chief Executive in Council; consequently the Secretary for Security had no jurisdiction to confirm the Director of Immigration's refusal and her decision was quashed; the Court did not decide the separate fairness issue about disclosure of the 8 March memorandum.
