The application for leave to appeal is refused because the impugned claims relate to common parts and under the Building Management Ordinance such rights must be pursued by the incorporated owners; the applicants therefore lack standing and their proposed grounds have no reasonable prospect of success; no other reason exists to justify a hearing.

The application was dismissed because the defendant waived or lost the right to challenge the District Court's jurisdiction by failing to raise the objection within the time limits under Order 12 r.8 and by actively participating in the proceedings (including filing pleadings and counterclaims); the defendant failed to discharge the burden to show that a mainland forum was clearly more appropriate and provided no persuasive evidence on mainland law or that Hong Kong was an inconvenient forum; limitation and other defences were not properly pleaded and require trial.
