The Appeal Committee held that the conviction was based on an act which in law could not amount to tampering with a motor vehicle; accordingly it granted leave to appeal by consent on that ground and directed the filing of a Joint Case, while dismissing the remaining grounds for leave under Rule 7 as not reasonably arguable.

The Magistrate's findings of fact (paragraph 109) provided ample basis to draw the irresistible inference that the appellant acted in concert as a lookout for the tampering; conviction was therefore upheld. On sentencing, appellate rehearing permitted reduction of the Magistrate's robust 8 months to 6 months imprisonment because the appellant had a clear record and stronger mitigation than the co-defendant.

The appellant was entitled to credit for approximately 10 days he spent in custody while the Immigration Department investigated his arrival; to give effect to that credit the sentence on count (c) was reduced from 15 months to 14.5 months, resulting in an effective total custodial period reduced from 17 months to 16.5 months.
