The Magistrate's findings of fact (paragraph 109) provided ample basis to draw the irresistible inference that the appellant acted in concert as a lookout for the tampering; conviction was therefore upheld. On sentencing, appellate rehearing permitted reduction of the Magistrate's robust 8 months to 6 months imprisonment because the appellant had a clear record and stronger mitigation than the co-defendant.

The magistrate's concurrent sentences, including 15 months for possession of a forged identity card intended to obtain work/disguise status, were in accordance with the Court of Appeal precedent in Li Chang Li; the appellant's mitigation did not justify reducing the sentence, therefore the appeal was dismissed and the sentences affirmed.

On the facts found by the trial judge (the respondent was the helmsman of the sampan during a high-speed chase with one unauthorised entrant aboard), the Court of Appeal held the trial judge erred in ordering concurrency and in the quantum of the sentence for the sea‑safety offence; the correct disposition was a 3‑year term for the Immigration offence and a 2‑year term for the Shipping and Port Control offence to run consecutively, producing an overall sentence of 5 years because the endangering conduct was of considerable seriousness and no mitigation warranted reduction.

The Court held that the assault, criminal intimidation and the perverting the course of justice offences were distinct from the money‑lending offences and therefore should not have been wholly concurrent; it varied the concurrency directions so that certain sentences run consecutively, leaving individual term lengths undisturbed, producing an aggregate of 36 months which was then reduced to 30 months to reflect the review discount.
