The trial judge was correct to prohibit cross-examination on a cautioned statement before the declarant gave evidence, but erred in disallowing cross-examination of D1 on the contents of tape-recorded conversations once she was in the witness-box; notwithstanding that irregularity the evidence against the appellant was sufficient and the proviso is applied to refuse leave to appeal.
