The Registrar erred in law and principle by applying party-and-party style reasonableness and over-relying on outdated Law Society rates when assessing an indemnity taxation; the Court substituted its assessment on key hourly rates and specific time/cost items and ordered a costs outcome reflecting those adjustments (see appendix adjustments) and made an order nisi awarding 70% of the costs of the taxation appeal on an indemnity basis.
