The application to vary the costs order nisi was dismissed because the inter partes Mareva hearing was not severable from the trial given substantial overlap in evidence and documentary bundles, the plaintiff had not shown sufficient diligence in progressing the case (notably failure to serve D2-D4), and therefore there was no justification for immediate summary assessment and payment of costs; the costs order nisi therefore becomes final and the plaintiff must pay the defendant's costs of the variation application.
