Refusal of the extension of time: although the delay was short, the applicant's explanation was doubtful and, crucially, the intended appeal had no reasonably arguable merit; accordingly no extension was granted and no need to address prejudice.

On the evidence before the Director and the Chief Executive in Council the applicant did not satisfy the dependency policy because his own written statements and his father's letter showed a primary purpose of seeking work/career; the decision-makers acted within their discretionary bounds, there was no material failure to take into account relevant factors that vitiated the decision, no procedural unfairness established by the allegation of oppressive conduct, and the judicial review application was therefore dismissed.

The Director had expressly considered whether the applicant constituted an exception to the dependency policy and there was no evidence he failed to take into account material matters; accordingly his refusal was not irrational and the court will not overturn the exercise of his discretion.
