The magistrate's starting points for the offences (use of another's identity card and contravening condition of stay) were appropriate and his overall total sentences were not to be disturbed; however the first appellant's sentence for misleading a police officer was excessive and should be reduced from 1 month to 21 days and ordered to run concurrently with the 6 month sentence for use of another's identity card, resulting in total terms of 9 months' imprisonment for each appellant.
