The appeal was dismissed because immigration records showed no lawful entry under the name or passport relied on, the appellant's evidence was inconsistent and not credible, and the magistrate's conviction and 15 months sentence for unlawfully landing and remaining were justified and properly imposed.

The Court held the judge correctly applied methamphetamine sentencing guidelines because there was no evidence the applicant believed he was supplying only ecstasy, the newly advanced mitigation was unsupported and raised late, the offences were persistent and targeted venues where young people congregate, guilty pleas attracted a one-third reduction and the total sentence of three years was appropriate and affirmed.

The magistrate's sentencing, once computed, resulted in a 12 month term to be served consecutive to an existing 4 month term; although the magistrate's verbal arithmetic was unclear and the totality principle could have justified a different structuring (concurrency between the two new terms), there was no error of law or manifest unfairness warranting interference and the appeal is dismissed.

The magistrate's starting points for the offences (use of another's identity card and contravening condition of stay) were appropriate and his overall total sentences were not to be disturbed; however the first appellant's sentence for misleading a police officer was excessive and should be reduced from 1 month to 21 days and ordered to run concurrently with the 6 month sentence for use of another's identity card, resulting in total terms of 9 months' imprisonment for each appellant.

Six months imprisonment was excessive given plea and restitution so sentence was reduced to four months, but disqualification for two years was lawful and appropriate under s.69(1)(h) of the Road Traffic Ordinance because the taxi was used in committing the offence and to escape, therefore the disqualification could not be limited to taxis and was upheld.
