The trial judge erred in under-weighting the criminality and multiplicity of premeditated offences; one set of such offences required a three-year term and, taking into account all offences, an overall starting point of four years was appropriate; applying a one-third discount for plea and cooperation reduced it to three years; because the review occurred at the end of the sentence a further six-month reduction was appropriate, resulting in a final sentence of two years and six months imprisonment.

The appeal was allowed in part: the sentence for breach of condition of stay was excessive in light of the appellant's surrender and was reduced from six to three months; the six month sentences for use of an unlawfully obtained travel document and for knowingly making a false representation were upheld and ordered to run concurrently with each other but consecutively to the three month term, producing a total of nine months' imprisonment.

The established magistracy appellate tariff for offences of making a false representation to an immigration officer and using an unlawfully obtained travel document is in the range of six to nine months; given the appellant's guilty plea and remorse and the absence of aggravating factors the sentence should be at the lower end and reduced to six months' imprisonment on each charge to run concurrently, substituting the original 12 months concurrent sentence.

The Court held that the Magistrate should have followed the categorisation in R. v. Bhagwant Singh Padda (Bewley J.) and that the appellant fell within the fourth category, warranting a reduction of the sentence from 12 months to nine months, which the Court interpreted as nine months after plea.
