The appellant is entitled to the costs of this Court, including costs of the leave applications, to be taxed if not agreed on the basis fit for two counsel; as to the courts below, a broad equal set-off between the parties is appropriate and therefore there should be no order as to costs in the Court of First Instance (HCCW 239/2018) and the Court of Appeal (CACV 321/2019).
