    The court exercised its discretion to permit withdrawal of the concession and admitted the expunged expert report for the de novo trial because the application was made in good faith, the de novo trial is a fresh hearing so no real prejudice would result to the respondent if appropriate case management directions and proportional measures are imposed, and the expert evidence on valuation of the artworks is relevant, necessary and likely to be helpful to the just adjudication of the ancillary relief dispute.

    The trial judge erred in construing the husband's remarks as abandonment of his claim which led to a failure to exercise discretion; on the available evidence (including business records and valuations) the Court could determine matrimonial assets and needs without remitting the matter and, applying LKW v DD principles and reasonable adjustments to profit estimates, it was just to order a lump sum ancillary relief payment of HK$800,000 from the wife to the husband.

    The Court of Appeal dismissed the appeal because the trial judge's exercise of discretion was within the generous ambit of reasonable disagreement: his valuations and treatment of the husband's assets (trusts, companies, options, properties) were rational and supported by evidence; there was no legal power to award interest on unpaid instalments before they became due; the costs orders and the overall capital/income division provided fair and adequate provision for the wife and children in all the circumstances, so intervention was not justified.
