The 1954 agreement effecting the parties' separation operated as a valid divorce under the law of Kwang Tung; even if procured by duress it was at most voidable and the respondent's 16‑year delay precluded rescission and relief; accordingly the marriage was treated as dissolved and the appeal was allowed.
