The Plaintiff proved on the evidence that the Defendant breached the subcontract by failing to pay wages, causing delay and producing defective work; payments made by the Plaintiff under statutory notice and to regain possession were necessary and recoverable; rectification and completion costs were reasonable; the administrative charge was a penalty and abandoned; set-off for amounts owing to the Defendant was applied; accordingly judgment was entered for the Plaintiff for the net sum of HKD 4,497,252 with interest and costs.
