The court held that MRCB failed to prove breach of natural justice or excess of jurisdiction sufficient to set aside the adjudication decision; procedural choices and alleged errors by the adjudicator do not invalidate the AD where reasons were given and the adjudicator acted within statutory powers, the adjudicator cannot be compelled to correct errors after being functus officio, the costs award under s18 CIPAA was permissible, and statutory requirements for enforcement under s28 CIPAA were satisfied.
