The Court refused the s.61 application because the applicant failed to satisfy the cumulative Parks/Murugayah requirements and the prerequisite of necessity under s.61: the medical reports were obtained long after trial without adequate explanation for delay, were not sufficiently relevant or probative to the charge of touching a male child’s genitals, and would not have created reasonable doubt at trial; therefore admission was not necessary for the justice of the case.
