The appeal was allowed because the Plaintiff failed to prove a contract with the 1st Defendant: the Proforma Invoice and Receipt/Delivery Order were not admitted and were proven to be forged by witness testimony and forensic report; there was no evidence of direct dealings or communications between Plaintiff and 1st Defendant, and payment into the 1st Defendant's account alone did not establish a contractual relationship or agency. Thus the Sessions Court's finding of a contract and principal-agent relationship as to the 1st Defendant was unsafe and was set aside.
