Prosecution failed to prove on the evidence that the monies seized from the nine accused were used or intended for gambling; staging of the scene and gaps in seizure documentation undermined the prosecution case; accordingly the court ordered the monies returned and refused forfeiture to the government.

The court held that the accused was charged with an offence under s15(1)(a) DDA which is a bailable offence; s39C is merely an enhanced penalty provision and does not alter the nature of the offence for bail purposes; s41B does not operate to deny bail in the circumstances because Parliament did not expressly include s39C-triggered cases in s41B and any construction depriving liberty would be disfavored; accordingly bail was granted and the Sessions Court order refusing bail was set aside.

Section 8(2) CLA constitutes an absolute bar to awarding exemplary damages under the CLA private-law estate claim, but that statutory bar does not preclude the executors of a deceased from bringing a separate public-law claim for breach of Article 5(1) Federal Constitution enforceable under Schedule 1 para 25 Courts of Judicature Act 1964; the Federal Court affirmed that constitutional infringement can attract exemplary (punitive) monetary relief as an appropriate public-law remedy and upheld the High Court's exemplary award of RM200,000 to the estate.
