Material and non‑mechanical discrepancies between the seizure inventory (P17), handover form (P22) and the physical exhibits, together with contradictions among prosecution witnesses and failure to prove exclusive control, custody or knowledge by the accused, destroyed the prosecution's case; information relied upon under section 27 was inadmissible because police had prior knowledge; on maximum evaluation the prosecution failed to prove a prima facie case under section 180 CPC and the accused must be acquitted.

The High Court found the prosecution proved all elements: an actual arrest occurred under s31A, the accused selected and provided a sealed urine sample with intact chain of custody, laboratory analysis confirmed methamphetamine, the statutory presumption under s37(k) stood unrebutted, and the Magistrate's factual findings were not plainly wrong; accordingly conviction and sentence were affirmed.

Court upheld trial judge's findings: expert forensic evidence and the totality of circumstantial evidence (exposed quantities of drugs, paraphernalia consistent with a lab, DNA profiles on multiple items, premises secured and items within close proximity to appellants, absence of cleaning equipment) established appellants had knowledge, control and participated in manufacturing/processing within the scope of s.2 DDA and had common intention under s.34 Penal Code; trial judge properly evaluated credibility and exhibit identification; therefore convictions and death sentences were affirmed.
