On the balance of probabilities the Official Receiver and Surendran failed to produce any application or written sanction authorising Surendran or Messrs. Amirtha VS & Co to act for the wound-up company; the OR cannot validly abrogate or wholesale delegate its statutory powers while it continues to act for the company; therefore Surendran is not entitled to act on behalf of D1 and Messrs. Amirtha VS & Co are disqualified/restrained from acting in the present suit; costs of RM3,000 awarded against Surendran.
