The Fourth Defendant owed no duty to conduct feasibility studies or to advise; the disbursement complied with the Facility terms; the Plaintiff executed the financing documents, accepted and partly repaid the Facility, and failed to show manifest error or misrepresentation; his conduct estopped him from disputing the account; accordingly the claim against the Fourth Defendant disclosed no reasonable cause of action and was struck out under Order 18 r.19.
