On the balance of probabilities the court found the defendant's version more probable: the motortreler was already in the right lane avoiding a broken lorry and the deceased's bus struck it from behind due to the deceased's failure to keep proper lookout; plaintiffs failed to discharge the burden of proof on negligence and material special damages, therefore plaintiffs' claims were dismissed; limited agreed special items were allowed and assessed where appropriate.
