The High Court upheld the Magistrate's finding that the cooperative was a 'producer' liable to pay SES because it held the MPOB licence for the estate and administratively managed and reported the planted area and produce (aggregate hectare sufficient), thus attracting liability under the SES Order 2007; the prosecution had established a prima facie case and the statutory exemptions did not apply to this cooperative.
