The Court upheld the trial judge: credible eyewitness evidence that appellant entered alone, was carrying the plastic later found to contain methamphetamine matching drugs in a locked room which appellant identified by key, established possession and knowledge; given the large quantities the statutory presumption under s.37(da) ADB applied and the appellant failed to rebut it on balance of probabilities, therefore convictions and sentences are affirmed.

Appellate court affirmed trial finding that prosecution proved possession and knowledge beyond reasonable doubt based on credible eyewitness evidence of appellant entering and leaving the premises with the plastic containing drugs, his conduct in indicating the locked room key, the matching type of drugs found in the room and the statutory presumption under s.37(da) ADB which appellant failed to rebut; accordingly convictions and sentences were upheld.

The Court upheld the convictions because credible direct evidence from undercover officers proved a negotiated sale to an agent provocateur; agent provocateur evidence is admissible under s.40A DDA and not displaced by the prosecution's failure to call other witnesses or produce corroborative documentary exhibits where no withholding was shown; the innocent carrier defence failed on the facts and wilful blindness applied; therefore the prosecution proved distribution and the elements required for conviction and the trial judge's factual findings stand.

Given the prior Court of Appeal finding of a prima facie case, the appellant failed to raise a reasonable doubt: the chain of custody was continuous and intact, investigative deficiencies were not established on the scant particulars provided by the appellant, and the innocent carrier defence failed because suspicious circumstances and material inconsistencies established at least wilful blindness; therefore conviction and sentence were affirmed.

The appellate court upheld the trial court's factual findings: the chain of custody was not broken and there was no evidence of tampering; the innocent carrier defence failed; although the trial judge erred in invoking s.114(g) Evidence Act the error was not fatal on the facts; prosecution proved possession of 2113.35g methamphetamine for purpose of trafficking under s.39B(1)(a) Dangerous Drugs Act 1952; conviction affirmed and death sentence set aside and substituted with 30 years' imprisonment from 8 May 2019 and 12 strokes.

The Court of Appeal affirmed conviction because the prosecution proved the identity and net weight of the drugs and that the appellant had custody and control, thereby properly invoking section 37(d) DDA; the appellant failed to rebut the presumption and the innocent carrier defence was rejected on wilful blindness; on sentence, exercising discretion under Act 846 the court commuted the death sentence to 30 years' imprisonment commencing from date of arrest plus 14 strokes of whipping.

The court found the prosecution proved beyond reasonable doubt that the accused had physical control and knowledge of the drugs (seen holding/disposing the package and fleeing), the chemical analysis established Methamphetamine in excess of 50g thereby raising the statutory presumption of trafficking, and the defence failed to rebut that presumption on the balance of probabilities; accordingly conviction under para 39B(1)(a) DDA 1952 was proper.
