The High Court found the impugned Sessions Court judgment did not turn on enforcement of a trust or stakeholder issue but on Plaintiffs' obligation to show documentary proof of payment to their client; res judicata/issue estoppel and precedents (Asia Commercial, Kayveas, Stone World) precluded relitigation and a mere assertion of lack of jurisdiction was insufficient. Therefore the defendant's application under the Rules was meritorious and allowed with costs.
