The application to file the new private valuation report (Iskandar Report) is dismissed because its admission would amount to an attempt to circumvent earlier refusals to amend Borang N and the Court of Appeal's affirmation; the Applicant failed to explain the substitution or reconcile conflicting valuations with the Scoot Report produced at the Land Administrator enquiry, and therefore did not establish a prima facie case under the Third Schedule; paragraph 4 of the Third Schedule prevents awarding compensation in excess of amounts claimed at the enquiry. Costs RM1000 awarded to Respondent.
