The Iskandar Report is inadmissible for the contested lots because it introduces compensation heads and higher claims outside the scope of the Applicant's Borang N and conflicts with the valuation relied on at the Land Administrator enquiry; absent satisfactory explanation the Applicant failed to establish a prima facie case as required by subparagraph 2(1) Third Schedule and paragraph 4 Third Schedule limits awards to amounts claimed at the enquiry; accordingly the application to file the new private valuation report is dismissed and costs awarded to Respondent.
