Registrar's Circular No.5/1990 validly permits petitions and all related cause papers in matrimonial proceedings under Act 164 and DMPR to be filed in English until the DMPR are translated and gazetted; Rules of Court 2012 (including Order 92) do not apply to matrimonial proceedings by virtue of Appendix C and Order 1 r2, therefore dismissal for failure to file Bahasa Malaysia translation was wrong and the appeal is allowed.

O.92 r.1(1) RC 2012 requires court documents to be in the national language and the Registrar's Circular is administrative and cannot displace that statutory requirement; the appellant did not satisfy the O.92 r.1(4) exception nor file the Bahasa Malaysia translation within the required period, therefore the High Court was correct to strike out enclosure 20 and the appeal is dismissed.

Where an affirmed English affidavit is permitted under the certificate of urgency provision of Order 92(1)(4), the subsequent national language translation filed as required need not itself be signed and affirmed; a one working day delay in filing that translation was an irregularity curable by an extension of time because no prejudice or substantial miscarriage of justice was shown and the defendant had not objected earlier, therefore the extension was granted and the preliminary objection dismissed.
