The court dismissed the preliminary objection and held that applications for stay of execution and appeals are procedural steps in the original proceedings and do not necessarily amount to initiation of new proceedings requiring leave under the vexatious litigant order; exercising its inherent jurisdiction under Order 92 r 4 ROC 2012 and having found special circumstances (interlocutory strike-out rather than full trial and the undeveloped status of the land), the court granted the stay of execution pending appeal and ordered costs payable by the plaintiffs to the 1st defendant.
