Section 4 of POCA is constitutionally valid as legislation enacted under Article 149 FC and does not offend the Federal Constitution or Article 121 as amended; however the specific remand orders under Section 4 in these cases were quashed because the Magistrate failed to exercise judicial discretion and comply with procedural and constitutional safeguards, so the appeals are allowed only in respect of those remand orders.
