The court held that the pre‑SPA EOT granted before 26‑11‑2019 remains effective in fact under Obata‑Ambak and so the Plaintiffs’ LAD claim based on the pre‑SPA EOT is unsustainable; the JR Plaintiffs’ maintenance of this writ while pursuing judicial review was an abuse of process (litigation by instalments) and unjustified; non‑JR Plaintiffs cannot rely on a challenge to the 2nd Covid EOT they did not join; accordingly the stay was dismissed and the striking out application allowed.

The Court held that regulation 11(3) is ultra vires (per Ang Ming Lee) so any extension under it and any amendment of the statutory Schedule H completion period to 54 months is void; estoppel cannot validate an ultra vires amendment; the appellant's cause of action for LAD accrued upon taking vacant possession (February 2017) and the claim filed in August 2020 is within the six-year limitation; writ proceedings were appropriate and Ang Ming Lee applies retrospectively absent a contrary pronouncement by the Federal Court.

The Court applied Ang Ming Lee to hold that Regulation 11(3) is ultra vires and any extension granted under it and any contractual amendment predicated on it (Clauses 25 and 27 to 54 months) are void; estoppel cannot validate a void statutory modification; the appellant's LAD claim accrued on delivery of vacant possession and was within the limitation period; the writ action was the correct mode as the extension is void ab initio; accordingly the High Court's refusal of summary judgment and striking out were set aside and summary judgment was ordered for the appellant.

The court held that the impugned ouster language in reg 12 HDR is invalid to the extent it purports to bar judicial review (contrary to articles 4(1), 5(1) and 121(1) FC and ultra vires s 24 HDA and s 23 IA); Ang Ming Lee applies retrospectively and confirms reg 11(3) HDR is ultra vires HDA so neither Controller nor Minister had power under HDR to extend the Schedule H 36‑month vacant possession period; the Minister's decision extending time is therefore quashed and applicants are entitled to claim LAD based on the 36‑month period; remittance under s 2(2) HDA and mandamus were declined.
