On the balance of probabilities the defective piles resulted from the Plaintiff's failure to ensure proper workmanship and cleaning of bore holes (bentonite/filter cake, bulging and necking) as the Plaintiff had contractual responsibility for quality assurance; therefore Plaintiff's payment claims fail and Defendant is entitled to recover rectification costs of RM1,096,745.73 plus interest and costs.
