The court held the pre-action discovery application was not a fishing expedition, the documents sought (activity reports relating to s4 functions of the Animal Welfare Board from establishment to date) were specified, relevant and necessary to determine whether plaintiffs could commence misfeasance proceedings, the Official Secrets Act objection failed in the absence of a s16A certificate, and the 1st–3rd plaintiffs (NGOs) had sufficient locus standi; accordingly limited pre-action discovery was granted confined to activity reports and procedural discovery forms were ordered.
