On the evidence the JC failed to prove that the DGI had not faithfully performed duties under s87 IA 1967 on the balance of probabilities; the DGI cannot be faulted for not lodging a caveat or registering title over the Seremban land because Malay Reserve statute prevents vesting in the DGI; notwithstanding, exercising court's powers the court ordered the DGI to lodge a police report against the Administrators within one month; the remainder of the appeal was dismissed with no order as to costs.
