The decision was set aside because the Land Administrator failed to serve the mandatory Form 2A notice on the registered proprietor (Perayu 1), thereby denying the proprietor the opportunity to be heard as required by Section 27 NLC; additionally the decision shows failure to properly consider the applicants' alternative route proposals and the requirement to connect to a public terminal, rendering the exercise of discretion under Sections 388–390 NLC unlawful and procedurally unfair.
