On the balance of probabilities the court found the developer had, by its internal IDB and accompanying evidence, accepted responsibility to pay solicitor's fees and thereby relieved buyers of that obligation; the statutory remuneration scale (SRO 2005) governs the quantum and overrides contrary provisions in the sale agreement, so the developer is liable to pay the plaintiff's fees as claimed under SRO 2005.
