The Sessions Court's factual finding that the payments reflected in Exhibit P7 amounted to an unexplained liability was reasonable on the balance of probabilities, Exhibit D8 failed to rebut the inference, 'suspicious payments' is a factual descriptor not a novel cause of action, non-joinder of the two individuals was not fatal under Order 15, and there was no legal or factual error warranting appellate interference; accordingly the Sessions Court judgment for RM170,570.08 and costs was upheld.
