The court held that the statutory definition of "issue" in section 3 of the Distribution Act 1958 includes descendants of deceased children and that, read together, sections 6(1)(c), 6(1)(h) and 7(1) entitle descendants of predeceased children who survive the intestate to inherit by representation; therefore the applicant's claim to exclude such descendants failed and the originating summons was dismissed.
