On the balance of probabilities the 27 June 2008 will was validly executed, the evidence did not establish lack of testamentary capacity or undue influence in 2008, while material and convincing suspicious circumstances surround the 9 March 2019 document (inconsistent assets, demonstrable post‑dating of listed account, indicia of reproduction/duplication); accordingly the 2008 will remains the last valid will, the 2019 document was not proven as genuine, the caveat is set aside and the original 2008 will returned to the First Defendant.

The plaintiff's pleadings failed to disclose a reasonable cause of action: the Bangsar property had already been transferred to the plaintiff pre‑death and the business proceeds were not shown to form part of the estate; allegations of forgery and lack of testamentary capacity were bare, unsupported and raised decades late, amounting to an abuse of process and susceptible to laches/res judicata; accordingly the defendants' strike out application succeeded and the suit was struck out with costs.
