The court held there was a bona fide serious issue as to whether the defendant's per square feet charging method contravened s25(3) of the Strata Management Act 2013, and the balance of convenience favoured granting a mandatory interim injunction because the plaintiffs hold approximately 80% of the units; accordingly the interim mandatory injunction allowing the plaintiffs to vote and participate at AGMs pending disposal of the suit was granted.
