The court held that the plaintiffs were not shown to be in arrears because the amounts were disputed in pending suits and therefore the statutory disqualification to vote did not arise; coupled with the fact the JMB has no statutory power to bar votes or to exercise enforcement powers reserved to the Commissioner of Buildings, the JMB acted beyond its powers and the three AGMs were invalid.
