The Turnkey Contract and contemporaneous conduct obligated the Defendant to procure CPC and CCC by 31-12-2019; material infrastructure works (wearing course, TNB connections, telecommunication and street lighting) remained outstanding as of that date and the works were only complete by 28-7-2020, therefore the CPC of 31-12-2019 was wrongly issued and the Defendant breached the contract entitling the Plaintiff to proven LAD and certain proven loss and expenses; Defendant's counterclaim fails.
