The Court of Appeal held that s29(1)(b) GPA 1956 precludes mandamus or any order compelling recovery or transfer of land from the Government; the 2009 declaratory order did not authorise transfer and therefore the s417 NLC order directing transfer was set aside; mandamus appeal dismissed; the appropriate remedy is assessment of adequate compensation (to be assessed by the High Court) as at the date of possession (3 December 1956) with statutory interest and deduction of amounts previously paid.

The Court of Appeal held that the High Court erred by conflating damages for existing contracts with contracts under negotiation; the Land Administrator's award of RM5,864,609.00 for compensation for existing contracts (business disruption) on Lot 1605 was justified and is reinstated. The Court dismissed LLM's appeal, allowed MMC Tepat Teknik's appeal in part, and otherwise affirmed the High Court's findings on valuation and entitlement related to the lots as appropriate to zoning and legality issues.

The court found the Land Administrator's valuation of RM1,300 psm excessive given the scheduled land's large size and hilly topography and accepted the assessors' joint view selecting the closest comparable (Lot 43376) with agreed adjustments (date +10%, size -30%, topography -20%) producing a net reduction of 50% to arrive at RM900 psm. Applying RM900 psm to the area taken produced RM155,955,850.20; injurious affection at 5% was affirmed (RM10,409,207.85). The award was reduced accordingly and interest ordered from Form K to full payment.
