The Court of Appeal dismissed the appeal and affirmed the High Court: the issuance of the Proclamation and the dissolution of the Sabah State Legislative Assembly are non-justiciable matters falling within the YDPN's absolute constitutional discretion under the Sabah Constitution (Articles 6,7,10,21); consequently leave for judicial review was correctly refused at the leave stage.
