Vacant possession is only effectively delivered when water and electricity are installed, tested, commissioned and supply is available for tapping into individual units; therefore late delivery period runs from scheduled delivery date until utilities are actually available in each unit. Liquidated damages must be calculated on the discounted sum actually paid by the purchaser pro rata by days overdue. Purchasers who have validly agreed settlements/consent judgments are bound by them and cannot pursue the same claims before the Tribunal; such Tribunal awards are quashed.
