Plaintiffs failed to prove on the balance of probabilities that the Defendant breached any implied term requiring a sale above RM250,000 because the Plaintiffs' sole documentary valuation (Notice of Stamp Duty) was hearsay in the absence of the JPPH valuer or other admissible expert evidence; applying market‑value principles and given the evidence before the Court, the sale at RM250,000 was held to be at market price and no loss was proven, therefore the Plaintiffs' claim is dismissed.
